Yani \u0130stanbul\u2019da 100 metrekare bir evin ayl\u0131k aidat bedeli 1800 liray\u0131 a\u015farken, Ankara\u2019da 20 liraya kadar geriliyor.<\/p>\n<p>Dikkat edin bu bedeller 100 metrekare i\u00e7in. Evin boyutu b\u00fcy\u00fcd\u00fck\u00e7e aidatlar da y\u00fckseliyor. Ortak kullan\u0131lan alanlardaki hizmetler (havuz, sosyal tesis vs.), \u00e7al\u0131\u015fan say\u0131s\u0131, \u0131s\u0131tman\u0131n \u015fekli vs aidat bedellerinin olu\u015fmas\u0131nda ba\u015fl\u0131ca etkenler. Son d\u00f6nemde \u00f6zellikle markal\u0131 konut projelerinde iki ayr\u0131 y\u00f6netim \u015fekli tercih ediliyor. Birincisi projeyi yapan firma belli s\u00fcre y\u00f6netimde kal\u0131yor. Ya da bir y\u00f6netim \u015firketiyle anla\u015farak projeden \u00e7ekiliyor.<\/p>\n<p>Markal\u0131 olmayan orta ve k\u00fc\u00e7\u00fck \u00f6l\u00e7ekli sitelerde ise y\u00f6netim kat malikleri aras\u0131ndan se\u00e7iliyor. Ayn\u0131 durum mahalle aras\u0131ndaki normal apartmanlar i\u00e7inde benzer bir durum s\u00f6z konusu. Varsa gelirler bu giderlerden d\u00fc\u015f\u00fcl\u00fcyor. Kalan k\u0131s\u0131m \u00f6nce malik say\u0131s\u0131na b\u00f6l\u00fcn\u00fcyor ve bir malikin y\u0131lda \u00f6demesi gereken aidat bulunuyor. Daha sonra bu da 12\u2019ye b\u00f6l\u00fcnerek ayl\u0131k aidat olu\u015fturuluyor.<\/p>\n<h2>B\u00dcT\u00c7EY\u0130 \u0130NCELEMEY\u0130 UNUTMAYIN!<\/h2>\n<p>Her malikin \u00f6ncelikle \u00e7\u0131k\u0131\u015f noktas\u0131 olan y\u0131ll\u0131k b\u00fct\u00e7eyi incelemesi, itiraz etmesi m\u00fcmk\u00fcn. Sat\u0131n alma, teklif alma gibi her karar\u0131n oylama ile al\u0131nmas\u0131 gerekli. Yani y\u00f6netimin kafas\u0131na g\u00f6re harcamalar planlay\u0131p sonra bu harcamalar\u0131 aidatlara yedirmesi gibi haks\u0131zl\u0131klar varsa ancak bu b\u00fct\u00e7elerin detayl\u0131 incelenmesiyle ortaya \u00e7\u0131kacakt\u0131r. Malikseniz bu b\u00fct\u00e7enin denetiminden, yap\u0131lan oylamalara kat\u0131lmaktan ve y\u00f6netim se\u00e7mekten siz sorumlusunuz unutmay\u0131n. Aidatlar\u0131 bir k\u0131s\u0131m maliklerin \u00f6dememesi ya da ge\u00e7 \u00f6demesi b\u00fct\u00e7eyi etkileyecektir. Eldeki paran\u0131n ortak giderlere yetmemesiyle ortaya \u00e7\u0131kacak zararlar da borcunu zaman\u0131nda \u00f6deyen maliklere de y\u00fck olup haks\u0131zl\u0131\u011fa neden olacakt\u0131r. Bu y\u00fczden geciken veya hi\u00e7 al\u0131namayan aidatlara baz\u0131 yasal faizler uygulan\u0131r. Ancak bu konudaki yasal h\u00fck\u00fcmler tam olarak bilinmedi\u011fi i\u00e7in \u00e7o\u011funlukla da bu uygulamalarda yanl\u0131\u015fl\u0131klar olur. Ben de apartmanlarda siteler de kavgalara neden olan gecikmi\u015f aidatlara uygulanmas\u0131 gereken yasal yapt\u0131r\u0131mlar\u0131 mercek alt\u0131na ald\u0131m. Bu konuda bilgi ve tecr\u00fcbesine g\u00fcvendi\u011fim Avukat Arif Hikmet Ayd\u0131n\u2019\u0131n g\u00f6r\u00fc\u015flerine ba\u015fvurdum. \u0130\u015fte Ayd\u0131n\u2019\u0131n dikkat \u00e7ekti\u011fi konular:<\/p>\n<p><b>&#8211; A\u0130DAT \u00d6DEMEK ZORUNDAYIZ:<\/b> Kat malikleri ortak yer veya tesisler \u00fczerinde kullanma hakk\u0131ndan vazge\u00e7mek veya kendi ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00fcn durumu dolay\u0131s\u0131yla bunlardan faydalanmaya l\u00fczum ve ihtiya\u00e7 bulunmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrmek suretiyle bu gider ve avans pay\u0131n\u0131 \u00f6demekten ka\u00e7\u0131namaz. (Aidat \u00f6demek zorunday\u0131z)<\/p>\n<p><b>&#8211; \u00d6DEMEZSEK AYDA Y\u00dcZDE 5 GEC\u0130KME TAZM\u0130NATI VAR:<\/b> Gider veya avans pay\u0131n\u0131 \u00f6demeyen kat maliki hakk\u0131nda, di\u011fer kat maliklerinden her biri veya y\u00f6netici taraf\u0131ndan y\u00f6netim plan\u0131na, bu Kanuna ve genel h\u00fck\u00fcmlere g\u00f6re dava a\u00e7\u0131labilir, icra takibi yap\u0131labilir. Gider ve avans pay\u0131n\u0131n tamam\u0131n\u0131 \u00f6demeyen kat maliki \u00f6demede gecikti\u011fi g\u00fcnler i\u00e7in ayl\u0131k (De\u011fi\u015fik ibare: 5711 &#8211; 14.11.2007 \/ m.9) \u201cy\u00fczde be\u015f\u201d hesab\u0131yla gecikme tazminat\u0131 \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p><b>&#8211; Y\u00dcZDE 5 GEC\u0130KME G\u00dcNL\u00dcK \u0130\u015eLER: <\/b>Ortak gider borcunu \u00f6demede gecikti\u011fi g\u00fcnlerin a\u00e7\u0131k\u00e7a belirlenmesinden sonra bu g\u00fcnler i\u00e7in ayl\u0131k % 5 hesab\u0131 ile gecikme tazminat\u0131n\u0131n hesaplanmas\u0131 gerekir. Yani 10 g\u00fcnl\u00fck gecikmeye 10 g\u00fcnl\u00fck faiz i\u015fletilir.<\/p>\n<p><b>&#8211; B\u0130LD\u0130R\u0130M \u015eART: <\/b>Yarg\u0131tay uygulamalar\u0131nda gecikme tazminat\u0131ndan sorumluluk kat malikinin aidatlar\u0131n belirlendi\u011fi kat malikleri kurulu toplant\u0131s\u0131na kat\u0131lmas\u0131, kat\u0131lmam\u0131\u015f ise al\u0131nan kat malikleri kurulu karar\u0131n\u0131n veya bu karar do\u011frultusunda olu\u015fturulan i\u015fletme projesinin kendisine tebli\u011f edilmesine ya da malik taraf\u0131ndan \u00f6\u011frenildi\u011finin ispatlanmas\u0131 ( aidat\u0131n \u00f6denmesi vb gibi ) halinde ba\u015flar.<\/p>\n<p><b>&#8211; GEC\u0130KME TAZM\u0130NATINA FA\u0130Z DE \u0130\u015eLER: <\/b>Yarg\u0131tay Hukuk Genel Kurulu \u201cKat M\u00fclkiyeti Yasas\u0131\u2019n\u0131n 20. maddesine vurgu yap\u0131p \u201cMaddede gecikme kar\u015f\u0131l\u0131\u011f\u0131 \u00f6denen mebla\u011f her ne kadar gecikme tazminat\u0131 olarak adland\u0131r\u0131lsa da, burada s\u00f6z konusu olan temerr\u00fct faizidir\u201d demi\u015ftir. Dolay\u0131s\u0131yla \u2018gecikme tazminat\u0131na\u2019 faiz y\u00fcr\u00fct\u00fclemez\u201d demi\u015fti. Ancak Kat M\u00fclkiyeti Kanunundan kaynaklanan ihtilaflara bakan Yarg\u0131tay 18. Hukuk Dairesi\u2019nin yak\u0131n tarihli kararlar\u0131na g\u00f6re, gecikme tazminat\u0131 faiz niteli\u011finde de\u011fildir. Bu nedenle \u2018gecikme tazminat\u0131na\u2019 temerr\u00fct tarihinden itibaren yasal faize h\u00fckmedilmesi gerekir.<\/p>\n<h2>100 L\u0130RA A\u0130DATI 1 YIL \u00d6DEMEMEN\u0130N FATURASI<\/h2>\n<p>AVUKAT Ayd\u0131n\u2019\u0131n dikkat \u00e7ekti\u011fi maddeleri \u00f6zetlemem gerekirse, \u00f6ncelikle belirteyim apartman, site y\u00f6netimlerinin, \u201cAidat 1 g\u00fcn bile gecikse y\u00fczde 5 faiz uygular\u0131z\u201d davran\u0131\u015f\u0131 do\u011fru de\u011fil. \u00d6rnekle a\u00e7\u0131klamam gerekirse \u00f6rne\u011fin her ay\u0131n 30\u2019unda \u00f6denmesi gereken 100 liral\u0131k aidat diyelim ki 12 g\u00fcn gecikti. Uygulanmas\u0131 gereken yasal form\u00fcl \u015fu:<\/p>\n<p>(100*0,05\/30*12=) 2 TL gecikme tazminat\u0131 al\u0131nabilir.<\/p>\n<p>\u0130kinci \u00f6nemli nokta. Aylarca \u00f6denmeyen aidatlara \u00f6nce ayl\u0131k y\u00fczde 5 gecikme tazminat\u0131 uygulan\u0131r. Aidat\u0131 \u00f6demesi gereken y\u00fck\u00fcml\u00fc yine de \u00f6deme yapmazsa y\u00f6netim dava a\u00e7abilir, haciz uygulatabilir. Bu durumda da hem \u00f6denmeyen aidatlara hem de gecikme tazminatlar\u0131na bir de yasal faiz i\u015fletilir. \u015eu anda ge\u00e7erli olan yasal faiz ise y\u00fczde 9\u2019dur.<\/p>\n<p>Yine \u00f6rnek vermem gerekirse. 100 liral\u0131k aidat\u0131n\u0131 12 ay boyunca \u00f6demeyen bir ki\u015fi i\u00e7in bu 12 ay\u0131 takip eden ayda bir dava a\u00e7\u0131l\u0131rsa mahkemeler;<\/p>\n<p>1200 lira (aidat)+ 60+55+50+45+40+35+30+25+20+15+10+5=390 TL (her ay i\u00e7in y\u00fczde 5 gecikme tazminat\u0131)= 1590 davaya konu tutar+\u00f6demenin yap\u0131laca\u011f\u0131 tarihe kadar 1590 lira \u00fczerinden yasal y\u00fczde 9 faiz \u00f6denmesine karar veriyor.<\/p>\n<p>&nbsp;<\/p>\n<p>H\u00fcrriyet<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>\u00a0Metrekare baz\u0131nda en y\u00fcksek aidatl\u0131 konut projesi 18.83 TL ile \u0130stanbul Avrupa yakas\u0131nda iken, metrekare baz\u0131nda en d\u00fc\u015f\u00fck aidatl\u0131 konut projesi ise ortalama 0.20 TL ile Ankara\u2019da bulunuyor.
