Be\u015fikta\u015f, \u015ei\u015fli, Sar\u0131yer, \u00dcsk\u00fcdar, Beykoz ve Kad\u0131k\u00f6y gibi il\u00e7elerde aidatlar\u0131n <\/span><\/span><span class=\"s6\"><span class=\"bumpedFont15\">15 bin TL\u2019den<\/span><\/span><span class=\"s8\"><span class=\"bumpedFont15\"> ba\u015flay\u0131p <\/span><\/span><span class=\"s6\"><span class=\"bumpedFont15\">70 bin TL\u2019ye<\/span><\/span><span class=\"s8\"><span class=\"bumpedFont15\">kadar \u00e7\u0131kmas\u0131, \u00f6zellikle b\u00fcy\u00fck ve l\u00fcks sitelerde ya\u015fayanlar i\u00e7in ciddi bir b\u00fct\u00e7e bask\u0131s\u0131 yarat\u0131yor.<\/span><\/span><\/p>\n<p class=\"s9\"><span class=\"s6\"><span class=\"bumpedFont15\">Kak\u0131c\u0131 &amp; \u015eim\u015fek Hukuk B\u00fcrosu Kurucu Orta\u011f\u0131 Av. Bu durum hem malikleri hem de kirac\u0131lar\u0131 do\u011frudan etkileyen yap\u0131sal bir soruna i\u015faret ediyor.\u201d<\/span><\/span><\/p>\n<p class=\"s10\"><span class=\"s6\"><span class=\"bumpedFont15\">Mevcut Sistem Neden Ele\u015ftiriliyordu?<\/span><\/span><\/p>\n<p class=\"s9\"><span class=\"s8\"><span class=\"bumpedFont15\">Halen y\u00fcr\u00fcrl\u00fckte olan Kat M\u00fclkiyeti Kanunu kapsam\u0131nda site y\u00f6neticileri, aidatlar\u0131 avans niteli\u011finde belirleyebiliyor ve ihtiya\u00e7 halinde yeniden toplama yetkisine sahip bulunuyor. Bu sistem, uygulamada y\u00f6neticilere geni\u015f bir hareket alan\u0131 tan\u0131rken, kat maliklerinin s\u0131n\u0131rl\u0131 m\u00fcdahalesi nedeniyle tart\u0131\u015fmalara yol a\u00e7\u0131yordu.<\/span><\/span><\/p>\n<p class=\"s9\">&nbsp;<\/p>\n<p class=\"s10\">&nbsp;<\/p>\n<p class=\"s9\"><span class=\"s6\"><span class=\"bumpedFont15\">Av. Buna g\u00f6re site y\u00f6neticilerinin belirledi\u011fi aidat tutarlar\u0131 art\u0131k do\u011frudan uygulanamayacak; kat malikleri kurulunun onay\u0131ndan ge\u00e7mesi gerekecek.<\/span><\/span><\/p>\n<p class=\"s9\"><span class=\"s8\"><span class=\"bumpedFont15\">\u015eim\u015fek, bu de\u011fi\u015fikli\u011fin \u00f6nemine dikkat \u00e7ekerek,<\/span><\/span> <span class=\"s8\"><span class=\"bumpedFont15\">\u201cBu d\u00fczenleme ile aidatlar\u0131n belirlenmesinde tek tarafl\u0131 karar alma d\u00f6nemi sona eriyor. Kat maliklerinin s\u00fcrece aktif kat\u0131l\u0131m\u0131 zorunlu hale geliyor\u201d <\/span><\/span><span class=\"s8\"><span class=\"bumpedFont15\">\u015feklinde konu\u015ftu.<\/span><\/span><\/p>\n<p class=\"s10\"><span class=\"s6\"><span class=\"bumpedFont15\">B\u00fcy\u00fck Sitelerde Karar Almak Kolayla\u015facak<\/span><\/span><\/p>\n<p class=\"s9\"><span class=\"s8\"><span class=\"bumpedFont15\">Teklifte yer alan bir di\u011fer \u00f6nemli de\u011fi\u015fiklik ise karar yeter say\u0131s\u0131na ili\u015fkin. \u00d6zellikle \u00e7ok s<\/span><\/span><span class=\"s8\"><span class=\"bumpedFont15\">ay\u0131da ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn bulundu\u011fu sitelerde y\u00f6netim plan\u0131 de\u011fi\u015fiklikleri i\u00e7in aranan \u00e7o\u011funluk oran\u0131 be\u015fte d\u00f6rtten \u00fc\u00e7te ikiye indiriliyor.<\/span><\/span><\/p>\n<p class=\"s9\"><span class=\"s8\"><span class=\"bumpedFont15\">Bu de\u011fi\u015fikli\u011fin pratikte \u00f6nemli sonu\u00e7lar do\u011furaca\u011f\u0131n\u0131 belirten <\/span><\/span><span class=\"s6\"><span class=\"bumpedFont15\">\u015eim\u015fek,<\/span><\/span> <span class=\"s8\"><span class=\"bumpedFont15\">\u201cY\u00fcksek \u00e7o\u011funluk \u015fart\u0131 nedeniyle al\u0131namayan kararlar, yeni oran sayesinde daha kolay hayata ge\u00e7irilebilecek. Ancak y\u0131ll\u0131k ola\u011fan aidat art\u0131\u015flar\u0131nda \u00fcst s\u0131n\u0131r uygulamas\u0131 \u00f6ng\u00f6r\u00fclm\u00fcyor.<\/span><\/span><\/p>\n<p class=\"s9\"><span class=\"s6\"><span class=\"bumpedFont15\">\u015eim\u015fek<\/span><\/span><span class=\"s8\"><span class=\"bumpedFont15\">, bu noktada dengeye dikkat \u00e7ek<\/span><\/span><span class=\"s8\"><span class=\"bumpedFont15\">erek <\/span><\/span><span class=\"s8\"><span class=\"bumpedFont15\">\u201cTam anlam\u0131yla bir tavan uygulamas\u0131 s\u00f6z konusu de\u011fil. Ancak uzmanlara g\u00f6re, sistemin sa\u011fl\u0131kl\u0131 i\u015flemesi i\u00e7in en \u00f6nemli unsur yine kat maliklerinin bilin\u00e7li ve aktif kat\u0131l\u0131m\u0131 olacak.<\/span><\/span><\/p>\n<p class=\"s13\"><span class=\"s11\"><span class=\"bumpedFont17\">Elvan Kak\u0131c\u0131 \u015eim\u015fek,<\/span><\/span><span class=\"s12\"><span class=\"bumpedFont17\"> Marmara \u00dcniversitesi Hukuk Fak\u00fcltesi mezunu olup Yeditepe \u00dcniversitesi Hukuk Fak\u00fcltesinde \u00d6zel hukuk alan\u0131nda y\u00fcksek lisans yapm\u0131\u015ft\u0131r. 2003-2005 y\u0131llar\u0131 aras\u0131nda Londra\u2019da bir hukuk b\u00fcrosunda \u00e7al\u0131\u015ft\u0131ktan sonra 2007 tarihinden bu yana Kak\u0131c\u0131 \u015eim\u015fek hukuk b\u00fcrosunun kurucu ortaklar\u0131ndand\u0131r. \u00d6zellikle Gayrimenkul hukuku, Aile hukuku, medeni hukuk ba\u015fta olmak \u00fczere \u00f6zel hukuk alan\u0131nda uzmanla\u015fm\u0131\u015ft\u0131r. Ayr\u0131ca son zamanlarda giri\u015fimcilerin ihtiya\u00e7lar\u0131 ile ortaya \u00e7\u0131kan Giri\u015fim Hukuku \u00fczerine de \u00e7al\u0131\u015fmalar yapmaktad\u0131r. Makaleleri \u00e7e\u015fitli yaz\u0131l\u0131 ve dijital bas\u0131mlarda yay\u0131nlanmakta olup hukuk\u00e7unun akademik y\u00f6n\u00fcn\u00fc s\u00fcrekli geli\u015ftirmesini \u00e7ok \u00f6nemsemektedir. T\u00fcrkiye Kad\u0131n Giri\u015fimciler Derne\u011fi, \u00d6zye\u011fin \u00dcniversitesi 10.000 Kad\u0131n Mezunlar\u0131 Derne\u011fi ve \u0130stanbul Barosu \u00fcyesidir.
