Yeni d\u00fczenleme, \u00f6zellikle riskli yap\u0131larda d\u00f6n\u00fc\u015f\u00fcm s\u00fcrecini h\u0131zland\u0131rmay\u0131 ve y\u0131llard\u0131r ya\u015fanan karar alma t\u0131kan\u0131kl\u0131klar\u0131n\u0131 a\u015fmay\u0131 hedefliyor.<\/p>\n<p>D\u00fczenlemeyi de\u011ferlendiren Kak\u0131c\u0131 &amp; \u015eim\u015fek Hukuk B\u00fcrosu Kurucu Orta\u011f\u0131 Av. Elvan Kak\u0131c\u0131 \u015eim\u015fek, yap\u0131lan de\u011fi\u015fikliklerin uygulamada d\u00f6n\u00fc\u015f\u00fcm\u00fc kolayla\u015ft\u0131raca\u011f\u0131n\u0131 ve s\u00fcreci daha i\u015fler hale getirece\u011fini vurgulad\u0131.<\/p>\n<h2>Riskli Yap\u0131larda Salt \u00c7o\u011funlukla Karar D\u00f6nemi<\/h2>\n<p>Yeni y\u00f6netmelikle birlikte; riskli alanlar, rezerv yap\u0131 alanlar\u0131 ve riskli yap\u0131 bulunan parsellerde, yap\u0131lar\u0131n y\u0131k\u0131lm\u0131\u015f olmas\u0131 \u015fart\u0131 aranmaks\u0131z\u0131n, maliklerin salt \u00e7o\u011funlu\u011fu ile \u00f6nemli kararlar al\u0131nabilecek.<\/p>\n<p>Bu kapsamda art\u0131k;<\/p>\n<ul>\n<li>parsel birle\u015ftirme,<\/li>\n<li>ifraz ve taksim i\u015flemleri,<\/li>\n<li>yeniden bina yap\u0131lmas\u0131,<\/li>\n<li>pay sat\u0131\u015f\u0131,<\/li>\n<li>kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat veya has\u0131lat payla\u015f\u0131m\u0131<\/li>\n<\/ul>\n<p>gibi uygulamalar \u00e7o\u011funluk karar\u0131yla hayata ge\u00e7irilebilecek. Bu de\u011fi\u015fiklik, \u00f6zellikle \u0130stanbul ba\u015fta olmak \u00fczere deprem riski y\u00fcksek b\u00f6lgelerdeki kentsel d\u00f6n\u00fc\u015f\u00fcm projeleri i\u00e7in kritik \u00f6nem ta\u015f\u0131yor.<\/p>\n<h2>Toplant\u0131 S\u00fcre\u00e7leri Kolayla\u015ft\u0131r\u0131ld\u0131<\/h2>\n<p>Y\u00f6netmelikte yap\u0131lan bir di\u011fer \u00f6nemli de\u011fi\u015fiklik, toplant\u0131 s\u00fcre\u00e7lerine ili\u015fkin oldu. Buna g\u00f6re, riskli yap\u0131 bulunan parsellerde d\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131 i\u00e7in toplant\u0131 yap\u0131labilmesi ad\u0131na maliklerden yaln\u0131zca birinin talebi yeterli olacak.<\/p>\n<p>Toplant\u0131 tarihi ve yeri;<\/p>\n<ul>\n<li>muhtarl\u0131kta,<\/li>\n<li>bina kap\u0131s\u0131nda ilan edilerek<\/li>\n<li>ya da noter arac\u0131l\u0131\u011f\u0131yla<\/li>\n<\/ul>\n<p>payda\u015flara bildirilecek. \u0130lan s\u00fcresinin tamamlanmas\u0131yla birlikte t\u00fcm maliklere tebligat yap\u0131lm\u0131\u015f say\u0131lacak ve toplant\u0131lar arsa paylar\u0131 oran\u0131nda salt \u00e7o\u011funluk ile ger\u00e7ekle\u015ftirilecek.<\/p>\n<h2>Karara Kat\u0131lmayan Maliklerin Hisseleri Sat\u0131\u015fa \u00c7\u0131kabilecek<\/h2>\n<p>Yeni d\u00fczenleme, al\u0131nan kararlara kat\u0131lmayan maliklere ili\u015fkin s\u00fcreci de netle\u015ftiriyor. Karar ve tekliflere dair belgeler; muhtarl\u0131kta, Kentsel D\u00f6n\u00fc\u015f\u00fcm Ba\u015fkanl\u0131\u011f\u0131, TOK\u0130, ilgili idare veya m\u00fcteahhit taraf\u0131ndan belirlenen adreslerde eri\u015fime a\u00e7\u0131lacak.<\/p>\n<p>Karar\u0131 kabul etmeyen maliklerin arsa paylar\u0131, rayi\u00e7 bedelden az olmamak kayd\u0131yla a\u00e7\u0131k art\u0131rma usul\u00fcyle di\u011fer payda\u015flara sat\u0131labilecek. Sat\u0131\u015f\u0131n ger\u00e7ekle\u015fmemesi durumunda ise bu hisseleri kamu kurumlar\u0131 devralabilecek.<\/p>\n<p>Y\u0131k\u0131m i\u015flemi tamamland\u0131ktan sonra tapu kay\u0131tlar\u0131ndaki \u201criskli yap\u0131\u201d \u015ferhi kald\u0131r\u0131larak yerine \u201c6306 say\u0131l\u0131 Kanun kapsam\u0131ndad\u0131r\u201d \u015ferhi i\u015flenecek.<\/p>\n<h2>Y\u0131k\u0131m Sonras\u0131 \u0130lk Al\u0131m Hakk\u0131 Kamuda<\/h2>\n<p>Riskli yap\u0131n\u0131n y\u0131k\u0131larak arsa haline gelmesinin ard\u0131ndan sat\u0131\u015f karar\u0131 al\u0131nmas\u0131 durumunda, sat\u0131\u015f \u00f6ncelikle Kentsel D\u00f6n\u00fc\u015f\u00fcm Ba\u015fkanl\u0131\u011f\u0131, Bakanl\u0131\u011fa ba\u011fl\u0131 kurulu\u015flar, ilgili idare veya TOK\u0130\u2019ye teklif edilecek. Kamu taraf\u0131ndan uygun g\u00f6r\u00fclmesi halinde, arsa pay\u0131n\u0131 alanlarla konut veya i\u015f yeri s\u00f6zle\u015fmesi yap\u0131labilecek.<\/p>\n<h2>Parsel Birle\u015ftirme ve \u0130mar Hakk\u0131 Aktar\u0131m\u0131 Netle\u015fti<\/h2>\n<p>Y\u00f6netmelik, parsel birle\u015ftirme ve imar hakk\u0131 aktar\u0131m\u0131 konular\u0131nda da yeni kriterler getiriyor. Buna g\u00f6re;<\/p>\n<ul>\n<li>Birden fazla parselin birle\u015ftirilebilmesi i\u00e7in t\u00fcm yap\u0131lar\u0131n riskli olarak tespit edilmi\u015f olmas\u0131 gerekecek.<\/li>\n<li>Bo\u015f parsellerin birle\u015ftirilmesinde ise bo\u015f parsel maliklerinin oybirli\u011fi \u015fart\u0131 aranacak.<\/li>\n<\/ul>\n<p>Zemin sorunlar\u0131 veya afet riski nedeniyle yap\u0131la\u015fman\u0131n m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 durumlarda, imar hakk\u0131 aktar\u0131m\u0131yla farkl\u0131 bir parsele ge\u00e7i\u015f m\u00fcmk\u00fcn olacak. Ancak bu durumda t\u00fcm maliklerin muvafakati gerekecek.<\/p>\n<p>Ayr\u0131ca tapu har\u00e7 ve \u00fccret muafiyetleri korunurken, 1 Ocak 2024 sonras\u0131 verilen yap\u0131 ruhsatlar\u0131nda teminatlar, m\u00fcteahhidin talebi halinde y\u00fczde 6 oran\u0131na g\u00f6re yeniden d\u00fczenlenebilecek.<\/p>\n<h2>\u201cAma\u00e7, Kentsel D\u00f6n\u00fc\u015f\u00fcm\u00fcn \u00d6n\u00fcndeki Kilitleri A\u00e7mak\u201d<\/h2>\n<p>D\u00fczenlemeyi de\u011ferlendiren Av. Elvan Kak\u0131c\u0131 \u015eim\u015fek, \u015fu ifadeleri kulland\u0131:<\/p>\n<p>\u201cBu de\u011fi\u015fikliklerle birlikte kentsel d\u00f6n\u00fc\u015f\u00fcm s\u00fcre\u00e7lerinde y\u0131llard\u0131r ya\u015fanan karar alma t\u0131kan\u0131kl\u0131klar\u0131n\u0131n \u00f6nemli \u00f6l\u00e7\u00fcde a\u015f\u0131lmas\u0131 hedefleniyor. Salt \u00e7o\u011funlukla karar al\u0131nabilmesi, \u00f6zellikle riskli yap\u0131larda d\u00f6n\u00fc\u015f\u00fcm\u00fcn h\u0131zlanmas\u0131n\u0131 sa\u011flayacak.
