Kira borcunu \u00f6demeyen gibi aidat borcunu da \u00f6demeyen kirac\u0131lar\u0131n tahliye edilebildi\u011fini s\u00f6yleyen Kara, \u201cB\u00f6yle bir durumda kiras\u0131n\u0131 veya aidat\u0131n\u0131 s\u00f6zle\u015fmeye g\u00f6re kararla\u015ft\u0131r\u0131lan zamanda \u00f6demeyen kirac\u0131 aleyhine kiraya veren konut sahibi kiracs\u0131na 30 g\u00fcnde \u00f6deme s\u00fcreli bir ihtarname g\u00f6nderebilecek ve ihtarnamenin kirac\u0131ya tebli\u011finden itibaren ise kirac\u0131 borcunu 30 g\u00fcnde \u00f6demez ise ev sahibi tahliye davas\u0131 a\u00e7abilecektir\u201d dedi.<\/p>\n<p>Konut aidatlar\u0131 son zamanlarda \u0130stanbul&#8217;da ev sahiplerinin ve kirac\u0131lar\u0131n korkulu r\u00fcyas\u0131 haline geldi. Pek \u00e7ok insan y\u00fcksek aidatlardan \u015fik\u00e2yet\u00e7i. Megakentte de aidatlar son zamanlarda kira ile yar\u0131\u015f\u0131r hale geldi, bir\u00e7ok il\u00e7ede y\u00fczde 100\u2019lere varan oranlarda aidat art\u0131\u015flar\u0131 oldu.<\/p>\n<h2>\u2018Bilinenin aksine kirac\u0131lar da sorumlu\u2019<\/h2>\n<p>Konut aidatlar\u0131, \u0130stanbul\u2019da ya\u015fayan ev sahiplerinin ve kirac\u0131lar\u0131n ortak derdi oldu. \u015eu anda ev sahipleri ve kirac\u0131lar aidatlar\u0131n\u0131 \u00f6demez ise ne ile kar\u015f\u0131la\u015fabilirler? Bu soruyla son zamanlarda s\u0131kl\u0131kla kar\u015f\u0131la\u015ft\u0131klar\u0131n\u0131 belirten Avukat O\u011fuz Kara, aidat borcundan sadece ev sahiplerinin de\u011fil kirac\u0131lar\u0131n da sorumlu oldu\u011funa dikkat \u00e7ekti.<\/p>\n<p>Avukat O\u011fuz Kara, \u201cKat M\u00fclkiyeti Kanunu\u2019nun (KMK) 20. maddesinde ortak b\u00fct\u00fcn giderler d\u00fczenleniyor. KMK\u2019a g\u00f6re, pay\u0131na d\u00fc\u015fen gider ve avans bor\u00e7lar\u0131ndan ve i\u015fleyecek gecikme tazminat\u0131ndan kat maliki ile kirac\u0131 da sorumlu tutuluyor. Yani bilindi\u011finin aksine aidat borcundan sadece kat maliki de\u011fil, kirac\u0131lar da sorumlu tutuluyor\u201d dedi.
