Uzmanlar bu gibi durumlarda yap\u0131lmas\u0131 gerekenler hakk\u0131nda bilgiler verdi. Sat\u0131\u015fa \u00e7\u0131kan konutun sat\u0131\u015f s\u00f6zle\u015fmesi yap\u0131ld\u0131\u011f\u0131, kapora verildi\u011fi halde tapudan sat\u0131\u015f olmadan d\u00f6nenler oldu. Emlak uzmanlar\u0131 al\u0131c\u0131 veya sat\u0131c\u0131n\u0131n \u00a0cayma hakk\u0131 oldu\u011funu, ancak baz\u0131 durumlarda vazge\u00e7en al\u0131c\u0131 veya sat\u0131c\u0131n\u0131n tazminatla cezas\u0131 \u00f6edemekle kar\u015f\u0131la\u015fabilece\u011fini s\u00f6yledi.<strong><em>\u00a0\u00a0<\/em><\/strong><strong><em>Peki konut sat\u0131\u015f\u0131 iptalinde t\u00fcketicinin haklar\u0131 nelerdir?<\/em><\/strong><\/p>\n<p>Konut piyasas\u0131nda al\u0131c\u0131n\u0131n ya da sat\u0131c\u0131n\u0131n imzalanan sat\u0131\u015f s\u00f6zle\u015fmesinden d\u00f6nme durumlar\u0131nda art\u0131\u015flar ya\u015fan\u0131yor. Ge\u00e7ti\u011fimiz aylarda ya\u015fanan dolardaki dalgalanmalar ve konut fiyatlar\u0131nda olu\u015fan art\u0131\u015f sebebi ile sat\u0131c\u0131lar\u0131n kafas\u0131 bir hayli kar\u0131\u015fm\u0131\u015ft\u0131. Konutunu satmay\u0131 d\u00fc\u015f\u00fcn\u00fcp emlak ofisi ile anla\u015fan bir\u00e7ok ev sahibinin \u2018acaba ucuza m\u0131 sat\u0131yorum\u2019 endi\u015fesi ile sat\u0131\u015ftan vazge\u00e7tiler. Konutu almay\u0131 planlayan ve konut i\u00e7in istenen paray\u0131 denkle\u015ftirmek amac\u0131 ile birikimlerini satan vatanda\u015flar zarara u\u011frad\u0131lar. Dolarda ki durulma sonras\u0131nda bu kez de konut al\u0131c\u0131lar\u0131 taraf\u0131nda iptaller gelmeye ba\u015flad\u0131. Bu al\u0131nan karar ise bu kez sat\u0131c\u0131lar\u0131n ma\u011fdur olmas\u0131na neden oldu.\u00a0<strong><em>Peki konut al\u0131m sat\u0131m\u0131nda son dakikada vazge\u00e7en taraf tazminat \u00f6der mi?\u00a0<\/em><\/strong><\/p>\n<div class=\"content-text\">\n<h2>\u0130spat etmek \u015fart<\/h2>\n<p>H\u00fcrriyet Gazetesi&#8217;nde G\u00fclistan Alag\u00f6z taraf\u0131ndan yap\u0131lan habere g\u00f6re; Avukat Elvan Kak\u0131c\u0131 \u015eim\u015fek taraf\u0131ndan bu soru \u015fu \u015fekilde cevapland\u0131: <em>\u201cTaraflar\u0131n aras\u0131nda yap\u0131lan mevcut bir s\u00f6zle\u015fme varsa s\u00f6zle\u015fme g\u00f6r\u00fc\u015fmeleri mevcuttur ve taraflar birbirlerine kar\u015f\u0131 d\u00fcr\u00fcstl\u00fck kurallar\u0131 \u00e7er\u00e7evesinde davranmak zorundad\u0131r. S\u00f6zle\u015fme hen\u00fcz kurulmam\u0131\u015f olmas\u0131na ra\u011fmen, kar\u015f\u0131 taraf\u0131n zarar g\u00f6rmesine sebep olan ki\u015fiye kar\u015f\u0131 zarar g\u00f6ren, borca ayk\u0131r\u0131l\u0131k sebebi ile tazminat talep edebilir. Dolay\u0131s\u0131yla; taraflardan birinin tapu sat\u0131\u015f\u0131 \u00f6ncesinde s\u00f6zle\u015fme g\u00f6r\u00fc\u015fmeleri s\u0131ras\u0131nda kusurlu davran\u0131\u015fta bulunmas\u0131 durumunda, zarar g\u00f6ren taraf zarara u\u011frad\u0131\u011f\u0131n\u0131 ispat etmek \u015fart\u0131 ile di\u011fer taraftan u\u011frad\u0131\u011f\u0131 zarar\u0131 tazminat davas\u0131 a\u00e7arak talep edebilir.\u201d<\/em><\/p>\n<h2>Kaporas\u0131 yanar m\u0131?<\/h2>\n<p>&#8220;Cayma hakk\u0131 do\u011fal olup kullan\u0131labilecek bir hakt\u0131r. Ancak bu hakk\u0131 kullan\u0131rken bunun baz\u0131 yapt\u0131r\u0131mlar\u0131n oldu\u011fu da unutulmamal\u0131d\u0131r&#8221; \u015feklinde belirten avukat \u015eim\u015fek al\u0131c\u0131n\u0131n \u00f6deddi\u011fi kapora konusunda da bilgi verdi. Avukat \u015eim\u015fek, &#8220;Emlak al\u0131m sat\u0131m\u0131 s\u00f6zle\u015fmesinde, almaktan cayma halinde \u2018verilen kaparoyu alamazs\u0131n\u0131z\u2019 y\u00f6n\u00fcnde bir h\u00fck\u00fcm yaz\u0131lm\u0131\u015fsa kaparonuzu geri alamazs\u0131n\u0131z&#8221; dedi. Konut sat\u0131c\u0131s\u0131n\u0131n vazge\u00e7mesi halinde ise \u00f6demesi ger\u00e7ekle\u015ftirilen kaporan\u0131n al\u0131c\u0131ya iade edilmesinin \u015fart oldu\u011funu belirten avukat \u015eim\u015fek,&#8221; kapora \u00f6demelerinin elden de\u011fil, banka yolu ile ve a\u00e7\u0131klama yaz\u0131larak yap\u0131lmas\u0131n\u0131&#8221; gerekyi\u011finin \u00f6nemini belirtti.<\/p>\n<h2>\u2018Emlak\u00e7\u0131n\u0131n s\u00f6zle\u015fmesi yok say\u0131l\u0131r\u2019<\/h2>\n<p>Emlak ofislerinde yap\u0131l\u0131p imzalanan s\u00f6zle\u015fmelerin hakk\u0131nda dikkat edilmesi gerekti\u011fini belirten gayrimenkul hukuku uzman\u0131 avukat\u0131 Ali G\u00fcven\u00e7 Kiraz \u015f\u00f6yle s\u00f6yledi: &#8220;T\u00fcrk hukuku i\u00e7inde esas olan gayrimenkul al\u0131m sat\u0131m\u0131n\u0131n tapuda olan devridir. Bu nedenle noterde d\u00fczenlenen gayrimenkul sat\u0131\u015f vaadi s\u00f6zle\u015fmeleri d\u0131\u015f\u0131nda, taraflar aras\u0131nda kendi yapt\u0131klar\u0131 d\u00fczenlemi\u015f olduklar\u0131 adi yaz\u0131l\u0131 s\u00f6zle\u015fmeler, emlak\u00e7\u0131larda d\u00fczenlenen al\u0131m-sat\u0131m s\u00f6zle\u015fmeleri yok h\u00fckm\u00fcndedir. (Tek istisnas\u0131 gayrimenkul\u00fcn sat\u0131n al\u0131nmas\u0131, bedelin \u00f6denmesi ve ta\u015f\u0131nmaz\u0131n teslim edilip i\u00e7erisinde oturulmas\u0131d\u0131r.) Yok h\u00fckm\u00fcnde d\u00fczenlenen bir s\u00f6zle\u015fmeye de cezai \u015fart konulmu\u015fsa o da yok h\u00fckm\u00fcndedir, yani istenemez. Al\u0131m sat\u0131mdan vazge\u00e7me durumunda taraflar\u0131n bir s\u00f6zle\u015fme ili\u015fkisine girmi\u015f olduklar\u0131 tespit edilmi\u015fse sadece u\u011fran\u0131lan \u2018menfi zararlar\u2019 (dolar\u0131n bozdurulmas\u0131 sonras\u0131 kur kayb\u0131, daha uygun \u015fartlarda ba\u015fka bir gayrimenkul alma imkan\u0131 varken bu imkan\u0131n kaybedilmesi veya fiyat\u0131n\u0131n y\u00fckselmesi gibi) ve \u2018m\u00fcspet zararlar\u2019 (\u00f6denmi\u015f har\u00e7, eve yap\u0131lan bir tadilat, al\u0131nm\u0131\u015f e\u015fya vb gibi) istenebilir.&#8221;<\/p>\n<p>Emlak komisyonlar\u0131 konusu hakk\u0131nda da bilgi veren avukat Kiraz, &#8220;Normal olarak emlak dan\u0131\u015fman\u0131 hizmet bedeli olan \u00f6demeyi almak i\u00e7in hizmeti tamamlamak zorunlulu\u011fundad\u0131r.
