Kat malikleriyle anla\u015fan m\u00fcteahhit 1 y\u0131l i\u00e7inde projeye ba\u015flamak zorunda. Ayr\u0131ca ba\u015flanan projelerde 6 aydan fazla ara verilemeyecek. Kat malikleri ya da arsa sahipleri \u015fartlar\u0131 kar\u015f\u0131layamayan \u015firketlerle anla\u015fmay\u0131 fesih edebilecek.\u201d<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131, 6306 say\u0131l\u0131 kanunun uygulama y\u00f6netmeli\u011finde yapt\u0131\u011f\u0131 de\u011fi\u015fiklikle konut sekt\u00f6r\u00fc i\u00e7in \u00f6nemli kararlara imza atm\u0131\u015ft\u0131. Y\u00f6netmeli\u011fin de\u011fi\u015ftirilmesinin \u00fcst\u00fcnden 1 y\u0131l ge\u00e7mesine ra\u011fmen vatanda\u015flar\u0131n haklar\u0131n\u0131 tam olarak bilmedi\u011fine dikkat \u00e7eken \u00dc\u00e7ay \u0130n\u015faat Genel Koordinat\u00f6r\u00fc Mehmet G\u00fcl, yeni konut alacaklara ya da evlerini kentsel d\u00f6n\u00fc\u015f\u00fcm kapsam\u0131nda kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat \u015firketine vermeyi d\u00fc\u015f\u00fcnenlere kritik uyar\u0131larda bulundu.<\/p>\n<p>Y\u00f6netmeli\u011fin vatanda\u015f\u0131 yak\u0131ndan ilgilendirdi\u011fini belirten Mehmet G\u00fcl; \u201cBakanl\u0131k uygulama y\u00f6netmeli\u011finde yapt\u0131\u011f\u0131 de\u011fi\u015fiklikle hen\u00fcz in\u015faat\u0131 ba\u015flamayan veya yeni ba\u015flanan projelerden konut sat\u0131\u015f\u0131 yap\u0131lmas\u0131n\u0131 yasaklad\u0131. 19 Ekim 2019 tarihli ve 30923 say\u0131l\u0131 resmi gazetede yay\u0131mlanan 6306 say\u0131l\u0131 kanunun uygulama y\u00f6netmeli\u011finde de\u011fi\u015fiklik yap\u0131lmas\u0131na dair y\u00f6netmelikte,\u00a0<strong>\u2018Yap\u0131m i\u015fini \u00fcstlenen m\u00fcteahhitlerin pay\u0131na d\u00fc\u015fen ba\u011f\u0131ms\u0131z birimlerin sat\u0131\u015f\u0131, in\u015faat\u0131n ilerleme seviyesine g\u00f6re ve idarenin iznine istinaden yap\u0131labilir\u2019<\/strong>\u00a0c\u00fcmlesi ge\u00e7iyor. Kanun, m\u00fcteahhite kat kar\u015f\u0131l\u0131\u011f\u0131 ald\u0131\u011f\u0131 bir i\u015fte kendi pay\u0131na d\u00fc\u015fecek b\u00f6l\u00fcm\u00fcn sat\u0131\u015f\u0131nda in\u015faat\u0131n ilerlemesi \u015fart\u0131n\u0131 koyuyor. Bir nevi ba\u015flamayan veya daha in\u015faat\u0131n ilk a\u015famalar\u0131nda olan projeden ev sat\u0131\u015f\u0131n\u0131 yasakl\u0131yor. \u0130n\u015faat ba\u015flad\u0131ktan sonra sat\u0131\u015f yapmak isteyen m\u00fcteahhit idareden izin almak zorunda. Ev alacak her vatanda\u015f\u0131n bunu bilmesi gerekiyor.\u201d bilgilerini payla\u015ft\u0131.<\/p>\n<p><strong>TOPRAKTAN SATI\u015eIN TEK \u0130ST\u0130SNASI VAR<\/strong><\/p>\n<p>M\u00fcteahhit pay\u0131na d\u00fc\u015fen ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin, in\u015faat\u0131n tamamlanma oran\u0131n \u00fcst\u00fcndeki bir oranda sat\u0131\u015f\u0131 ger\u00e7ekle\u015febilece\u011fi baz\u0131 durumlar\u0131n oldu\u011funu hat\u0131rlatan Mehmet G\u00fcl, \u201cM\u00fcteahhit pay\u0131na d\u00fc\u015fen ba\u011f\u0131ms\u0131z birimlerin, in\u015faat\u0131n tamamlanma oran\u0131nda veya bu oran\u0131n \u00fcst\u00fcndeki bir oranda sat\u0131\u015f\u0131 i\u00e7in b\u00fct\u00fcn maliklerin muvafakati gerekir. Binadaki t\u00fcm kat malikleri firmaya muvafakat vermesi durumunda m\u00fcteahhit in\u015faat\u0131n ilerleme oran\u0131na bak\u0131lmaks\u0131z\u0131n t\u00fcm dairelerin sat\u0131\u015f\u0131n\u0131 yapabilir. \u015eayet muvafakat verilmemesi durumunda ise firman\u0131n dairelerini satabilmesi i\u00e7in in\u015faat\u0131n belirli bir k\u0131sm\u0131n\u0131n tamamlanmas\u0131, tamam\u0131n\u0131n sat\u0131labilmesi i\u00e7inse yap\u0131 kullanma izin belgesi al\u0131nmas\u0131 gerekiyor. Bu durumlarda m\u00fcteahhit pay\u0131na d\u00fc\u015fen ba\u011f\u0131ms\u0131z birimlerin tamam\u0131n\u0131n sat\u0131\u015f\u0131 yap\u0131labilir.\u201d dedi.<\/p>\n<p><strong>ANLA\u015eMADAN SONRA M\u00dcTEAHH\u0130T 1 YIL \u0130\u00c7\u0130NDE \u0130\u015eE BA\u015eLAMAZ \u0130SE NE OLUR?<\/strong><\/p>\n<p>Y\u00f6netmelik ile vatanda\u015flar\u0131n ya\u015fad\u0131\u011f\u0131 ba\u015fka sorunlara da \u00e7\u00f6z\u00fcm getirildi\u011fini ifade eden \u00dc\u00e7ay \u0130n\u015faat Genel Koordinat\u00f6r\u00fc Mehmet G\u00fcl, \u201cGe\u00e7ti\u011fimiz y\u0131llarda kat malikleri ile anla\u015fma sa\u011flayan \u015firketler, binan\u0131n d\u00f6n\u00fc\u015f\u00fcm s\u00fcresini kendi belirliyordu. 1 y\u0131ldan \u00e7ok k\u0131sa s\u00fcrede projeye ba\u015flay\u0131p yol kat eden firmalar oldu\u011fu gibi in\u015faat\u0131n ba\u015flama s\u00fcresinin 3-4 y\u0131la kadar uzatan veya daha uzun y\u0131llar ba\u015flamayan firmalar vard\u0131. Yeni kanun ile kat malikleriyle s\u00f6zle\u015fme imzalayan firmalar 1 y\u0131l i\u00e7inde \u00e7al\u0131\u015fmalara ba\u015flamak zorunda. E\u011fer s\u00f6zle\u015fmenin imzalanmas\u0131ndan sonraki 1 sene i\u00e7inde m\u00fcteahhit kaynakl\u0131 problemlerden dolay\u0131 in\u015faat ba\u015flamam\u0131\u015f ise s\u00f6zle\u015fme fesih edilebilir ve kat malikleri ba\u015fka bir \u015firket ile yeniden anla\u015fma yapabilir.\u201d \u015feklinde konu\u015ftu.<\/p>\n<p><strong>BA\u015eLANAN PROJEYE 6 AY ARA VER\u0130RL\u0130RSE DE S\u00d6ZLE\u015eME \u0130PTAL OLUYOR<\/strong><\/p>\n<p>Yap\u0131m i\u015fine ba\u015flanm\u0131\u015f ve sonras\u0131nda \u00e7al\u0131\u015fmay\u0131 durdurarak vatanda\u015f\u0131 ma\u011fdur eden \u015firketlere de yapt\u0131r\u0131mlar geldi\u011finim alt\u0131n\u0131 \u00e7izen Mehmet G\u00fcl \u015funlar\u0131 s\u00f6yledi: \u201cKat malikleri \u015firket ile anla\u015fmay\u0131 ger\u00e7ekle\u015ftirdikten sonra in\u015faat\u0131n herhangi bir seviyesinde 6 aydan fazla s\u00fcreci kesintiye u\u011fratamaz. S\u00f6zle\u015fmenin malikler taraf\u0131ndan tek tarafl\u0131 fesih edilebilmesi i\u00e7in yap\u0131m i\u015finin belirli bir seviyede durdurulmu\u015f ve en az 6 ayd\u0131r projenin bitirilmesini gerektirecek seviyede ekip ve ekipmanla in\u015faata devam etmiyor olmas\u0131 gerekir. \u0130\u015finin durduruldu\u011funun ve en az alt\u0131 ayd\u0131r projenin bitirilmesini gerektirecek seviyede ekip ve ekipmanla devam edilmedi\u011finin, ilgili idarenin tespit, tutanak ve kay\u0131tlar\u0131, yap\u0131 denetimi sistemindeki kay\u0131tlar, foto\u011fraflar, uydu g\u00f6r\u00fcnt\u00fcleri vb. bilgi ve belgeler ile ortaya konulmas\u0131 gerekir.
