T\u00fcm Giri\u015fimci Emlak M\u00fc\u015favirleri Derne\u011fi Ba\u015fkan\u0131 Hakan Akdo\u011fan konut g\u00fcvenirli\u011fini \u00f6l\u00e7menin yollar\u0131 hakk\u0131nda bilgi verdi.<\/p>\n<p>Vatanda\u015flar\u0131n binalar\u0131n\u0131n riskli olup olmad\u0131\u011f\u0131n\u0131 \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 taraf\u0131ndan yetkilendirilmi\u015f kurum ve kurulu\u015flara ba\u015fvurarak \u00f6\u011frenebileceklerini belirten Akdo\u011fan, \u201cBinada oturan gayrimenkul sahiplerinden birinin \u015fahsen veya kanuni temsilcisi arac\u0131l\u0131\u011f\u0131yla ba\u015fvuruda bulunmas\u0131 yeterli. Ba\u015fvuru i\u00e7in \u00e7o\u011funluk karar\u0131 aranmaz. Riskli yap\u0131 tespiti ba\u015fvurusunda bulunmak i\u00e7in gayrimenkul sahibinin kimlik fotokopisi ve tapunun ibraz edilmesi gerekiyor\u201d dedi.<\/p>\n<p>Riskliyse y\u0131k\u0131l\u0131yor<\/p>\n<p>Riskli yap\u0131 tespitleri ve y\u0131k\u0131m i\u015flerinin masraflar\u0131n\u0131 maliklerin kar\u015f\u0131lad\u0131\u011f\u0131n\u0131 belirten Akdo\u011fan, \u201cRiskli olarak tespit edilen binalar Tapu M\u00fcd\u00fcrl\u00fc\u011f\u00fcne bildirilir ve tapu k\u00fct\u00fc\u011f\u00fcne i\u015flenir. Malikler, tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce yap\u0131lacak tebligattan itibaren 15 g\u00fcn i\u00e7inde, \u00c7evre ve \u015eehircilik \u0130l M\u00fcd\u00fcrl\u00fckleri\u2019ne verecekleri bir dilek\u00e7eyle riskli yap\u0131 tespitine itiraz edebilirler. \u0130lgili idare taraf\u0131ndan tebligat yoluyla riskli olarak tespit edilen ta\u015f\u0131nmaz\u0131n maliklerine 60 g\u00fcnden az olmamak \u00fczere s\u00fcre verilerek yap\u0131n\u0131n y\u0131kt\u0131r\u0131lmas\u0131 istenir. Yap\u0131 maliklerinin m\u00fcracaat\u0131 \u00fczerine, idare taraf\u0131ndan y\u0131k\u0131m ruhsat\u0131 d\u00fczenlenir. Riskli binan\u0131n y\u0131kt\u0131r\u0131lmas\u0131ndan sonra arsa h\u00e2line gelen ta\u015f\u0131nmazlar\u0131n malikleri taraf\u0131ndan de\u011ferlendirilmesine esas olacak ve yap\u0131lacak uygulamalara sahip olduklar\u0131 hisseleri oran\u0131nda maliklerin en az 2\/3 \u00e7o\u011funlu\u011fu ile karar verilecektir. Anla\u015fmaya kat\u0131lmayan (2\/3 \u2018\u00fcn d\u0131\u015f\u0131nda kalan) maliklerin ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerine ili\u015fkin arsa paylar\u0131, Bakanl\u0131k\u00e7a rayi\u00e7 de\u011feri tespit ettirilerek -bu de\u011ferden az olmamak \u00fczere- anla\u015fma sa\u011flayan di\u011fer payda\u015flara a\u00e7\u0131k art\u0131rma usul\u00fc ile sat\u0131l\u0131r. Bu suretle payda\u015flara sat\u0131\u015f ger\u00e7ekle\u015ftirilemedi\u011fi takdirde, bu paylar, Bakanl\u0131\u011f\u0131n talebi \u00fczerine, tespit edilen rayi\u00e7 bedeli de Bakanl\u0131k\u00e7a \u00f6denmek kayd\u0131 ile tapuda Hazine ad\u0131na resen tescil edilir\u201d diye konu\u015ftu.<\/p>\n<p>G\u00fc\u00e7lendirme de m\u00fcmk\u00fcn<\/p>\n<p>Akdo\u011fan riskli yap\u0131n\u0131n y\u0131kt\u0131r\u0131lmas\u0131 yerine g\u00fc\u00e7lendirilmesi de de\u011ferlendirilebilece\u011fine dikkat \u00e7ekerek \u015funlar\u0131 s\u00f6yledi: \u201cAncak bunun i\u00e7in de g\u00fc\u00e7lendirmenin teknik olarak m\u00fcmk\u00fcn oldu\u011funun tespit ettirilmesi, Kat M\u00fclkiyeti Kanunu\u2019nun 19. maddesinin ikinci f\u0131kras\u0131nda belirtilen \u015fekilde (4\/5 \u00e7o\u011funluk ile) g\u00fc\u00e7lendirme karar\u0131 al\u0131nmas\u0131, g\u00fc\u00e7lendirme projesinin haz\u0131rlat\u0131lmas\u0131 ve imar mevzuat\u0131 \u00e7er\u00e7evesinde ruhsat al\u0131nmas\u0131 gerekir.
