Bankalar\u0131n konut kredilerini yap\u0131land\u0131rmamas\u0131, h\u00e2kim bu durumun k\u00f6t\u00fcye kullan\u0131lmas\u0131d\u0131r. 4054 say\u0131l\u0131 kanunun 58. maddesi kapsam\u0131nda, t\u00fcketici mahkemesi olay\u0131n h\u00e2kim durumun k\u00f6t\u00fcye kullan\u0131lmas\u0131 olup olmad\u0131\u011f\u0131n\u0131 bilirki\u015fiye tespit ettirebilir. Siz de b\u00f6ylece \u00f6dedi\u011finiz bedelle krediniz yap\u0131land\u0131r\u0131lsayd\u0131 \u00f6deyece\u011finiz bedel aras\u0131ndaki fark\u0131 bu dava ile bankan\u0131zdan talep edebilirsiniz.<\/p>\n<h2>\u0130ster uzak ister yak\u0131n tarih<\/h2>\n<p>\u0130ster uzak tarihte, isterse yak\u0131n bir tarihte \u00e7ekilmi\u015f olsun, t\u00fcm t\u00fcketicilerin yap\u0131land\u0131rmadan faydalanmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Zira s\u00f6zle\u015fmenin bir h\u00fckm\u00fc, t\u00fcketicinin bir menfaatini a\u00e7\u0131k\u00e7a ihlal ediyorsa, art\u0131k bu kayd\u0131n hukuken ge\u00e7erli oldu\u011funu s\u00f6yleyemeyiz. Al\u0131nan kredinin ayl\u0131k taksitleri bin 606.01 TL ve 12 ay \u00f6deme yap\u0131ld\u0131\u011f\u0131n\u0131 varsayal\u0131m kalan toplam \u00f6deme ise 173 bin 449,082 TL<\/p>\n<p>Bankan\u0131z\u0131n sundu\u011fu yap\u0131land\u0131rma faiz oran\u0131 ise 120 ay vade i\u00e7in y\u00fczde 0,99 \u015feklinde olursa ve y\u00fczde 2.00 kredi kapama cezas\u0131 \u00f6denmesi ko\u015fulu oldu\u011funu da g\u00f6z \u00f6n\u00fcne al\u0131rsak, masraflar hari\u00e7 ayl\u0131k \u00f6demeniz gereken tutar bin 360,61 lira olur. Kalan toplam borcunuz yap\u0131land\u0131rma sonras\u0131 163,273.20 TL&#8217;ye d\u00fc\u015fer.
