E\u011fer m\u00fcteahhit idareden in\u015faat\u0131n tamamland\u0131\u011f\u0131na dair yaz\u0131 al\u0131rsa, \u00a0veya yap\u0131 kullanma izin belgesi sunarsa pay\u0131na d\u00fc\u015fen ba\u011f\u0131ms\u0131z birimlerin tamam\u0131n\u0131 satabilecek\u201d diye konu\u015ftu.<\/p>\n<h2><strong>Fesh Hakk\u0131 Kullan\u0131labilecek<\/strong><\/h2>\n<p>D\u00fczenlemede hak sahiplerinin m\u00fcteahhitle imzalad\u0131\u011f\u0131 s\u00f6zle\u015fmeyi de fesh edebilecekleri \u015fartlar\u0131n belirlendi\u011fini belirten \u00d6zelmac\u0131kl\u0131 \u201cB\u00fct\u00fcn malikler ile anla\u015fma sa\u011flanmas\u0131 ve yap\u0131m i\u015fine engel hukuki bir gerek\u00e7e olmadan bir y\u0131l i\u00e7inde yap\u0131m i\u015fine ba\u015flanmaz ise veya yap\u0131m i\u015fi belirli bir seviyede durdurulmu\u015f ve en az alt\u0131 ayd\u0131r projenin bitirilmesini gerektirecek seviyede in\u015fai faaliyete devam edilmiyorsa fesh hakk\u0131 kullan\u0131labilecek. Fesih sonras\u0131nda, ba\u015fvuru yap\u0131l\u0131rsa ta\u015f\u0131nmazlar\u0131n tapu kayd\u0131na \u015ferh edilmi\u015f olan gayrimenkul sat\u0131\u015f vaadi s\u00f6zle\u015fmeleri ile arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmeleri ilgili tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce terkin edilece, hatta m\u00fcteahhit taraf\u0131ndan hak sahiplerine yap\u0131lan kira yard\u0131m\u0131 \u00f6demeleri de hak sahiplerinden geri talep edilemeyecek\u201d \u015feklinde konu\u015ftu.<\/p>\n<h2><strong>Ma\u011fdurlar \u0130\u00e7in Beklenen D\u00fczenleme<\/strong><\/h2>\n<p>Sat\u0131\u015flar\u0131n \u00f6nceki aylarda d\u00fc\u015f\u00fc\u015f g\u00f6stermesi, maliyetlerin art\u0131\u015f\u0131 nedeni ile bir\u00e7ok kentsel d\u00f6n\u00fc\u015f\u00fcm alan\u0131nda bina y\u0131k\u0131mlar\u0131n ger\u00e7ekle\u015fip in\u015faatlar\u0131n ba\u015flat\u0131lmad\u0131\u011f\u0131n\u0131, kira yard\u0131mlar\u0131n\u0131n da s\u00fcresinin \u00e7oktan doldu\u011funu belirten Alt\u0131n Emlak Genel M\u00fcd\u00fcr\u00fc \u201cD\u00fczenleme ile ma\u011fduriyetlerinin \u00f6n\u00fcne ge\u00e7ilebilecek. Bakanl\u0131k, idare veya TOK\u0130 d\u0131\u015f\u0131ndaki ger\u00e7ek ve \u00f6zel hukuk t\u00fczel ki\u015filerince ger\u00e7ekle\u015fen uygulamalar bu d\u00fczenlemeye tabi olacak.
