Riskli binan\u0131n y\u0131k\u0131m\u0131 ise 60 g\u00fcnde bitirilecek.<\/b><\/p>\n<p>\u0130stanbul Kartal il\u00e7emizde 6 \u015eubatta aniden \u00e7\u00f6ken bina ve \u00c7anakkale Ayvac\u0131k il\u00e7esinde ge\u00e7ti\u011fimiz hafta meydana gelen korkutan deprem sonras\u0131 T\u00fcrkiye\u2019deki riskli binalar\u0131 yeniden g\u00fcndeme geldi. Milliyet Aykut Y\u0131lmaz&#8217;\u0131n yapt\u0131\u011f\u0131 haberine g\u00f6re \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 ge\u00e7ti\u011fimiz g\u00fcnlerde belediyelere bir genelge yollalyarak \u00fc\u00e7 ay i\u00e7erisinde riskli binalar\u0131n bakanl\u0131\u011fa bildirilmesi istenmi\u015fti. Peki riskli binalar nas\u0131l belirlenecek? \u0130\u015fte o sorunun yan\u0131t\u0131:<\/p>\n<h2><strong>1- Riskli yap\u0131 ne demek?<\/strong><\/h2>\n<p>Riskli yap\u0131, sel,\u00a0deprem, heyelan ve bunlar gibi muhtemel bir afette i\u00e7inde ya\u015fayanlar\u0131n can g\u00fcvenli\u011finin olmad\u0131\u011f\u0131 yap\u0131lard\u0131r. Riskli alanlar i\u00e7erisinde ya da d\u0131\u015f\u0131nda olup ekonomik s\u00fcresini tamamlayan ya da y\u0131k\u0131lma veya a\u011f\u0131r hasar g\u00f6rme riski ta\u015f\u0131d\u0131\u011f\u0131 ilmi ve teknik verilere dayanarak tespiti yap\u0131n yap\u0131 ya da yap\u0131lar da riskli yap\u0131 kapsam\u0131na giriyor.<\/p>\n<h2><strong>2- Riskli yap\u0131lar nas\u0131l tespit edilir?<\/strong><\/h2>\n<p>Riskli yap\u0131 tespiti, \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 taraf\u0131ndan lisansland\u0131r\u0131lm\u0131\u015f kurum ve kurulu\u015flarca yap\u0131l\u0131yor. M\u00fclk maliklerden birisinin ya da kanuni temsilcisinin m\u00fcracaat\u0131 ile bu tespit de yap\u0131labilir. M\u00fcracaat i\u00e7in dilek\u00e7e, g\u00fcncel tapu durum belgesi ve kimlik belgesi fotokopisi gerekiyor.<\/p>\n<h2><strong>3- Hangi kriterlerle riskli yap\u0131 karar\u0131 veriliyor?<\/strong><\/h2>\n<p>Riskli yap\u0131 karar\u0131 i\u00e7in bak\u0131lan baz\u0131 kriterler var. Yap\u0131lar\u0131 denetiminde m\u00fcracaat sonras\u0131nda betonlar\u0131n dayanma g\u00fcc\u00fcne, i\u00e7erisindeki demirlerin durumu, ta\u015f\u0131y\u0131c\u0131 sistem durumu, binan\u0131n dayanma g\u00fcc\u00fcne bak\u0131l\u0131yor. Ayr\u0131ca betonlar\u0131n ve demirlerin de say\u0131ld\u0131\u011f\u0131 bir s\u00fcre\u00e7den de ge\u00e7iriliyor. Binan\u0131n dayanma g\u00fcc\u00fc zay\u0131f olmas\u0131 ve di\u011fer kriterlerde eksiklik olmas\u0131 durumunda bina riskli say\u0131l\u0131yor.<\/p>\n<h2><strong>4- Riskli binad\u0131r karar\u0131n\u0131 kim veriyor?<\/strong><\/h2>\n<p>Binalar\u0131n yap\u0131lan kontrolleri sonras\u0131nda, riskli oldu\u011fu belirtilen yap\u0131lar, ilgili kurum ve kurulu\u015flarca \u00c7evre ve \u015eehircilik \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc veya yetki verilmesi halinde idareye bildiriliyor. \u00c7evre ve \u015eehircilik il m\u00fcd\u00fcrl\u00fckleri veya idareler taraf\u0131ndan raporlar inceliyor. Raporlarda eksik ya da yanl\u0131\u015fl\u0131klar olmas\u0131 durumunda raporlar ilgili ki\u015fiye iade ediliyor. Di\u011fer uygun bulunan tespitlere ili\u015fkin \u015ferh bildirimi ile ilgili tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcne iletiliyor.<\/p>\n<h2><strong>5- Riskli yap\u0131n\u0131n 60 g\u00fcn i\u00e7inde y\u0131kt\u0131r\u0131lmas\u0131 gerekiyor<\/strong><\/h2>\n<p>Tapu k\u00fct\u00fc\u011f\u00fcnce i\u015flenen bilgiler, riskli yap\u0131 tespitine kar\u015f\u0131 tebligat tarihinden sonras\u0131nda 15 g\u00fcn i\u00e7inde riskli yap\u0131n\u0131n bulundu\u011fu yerdeki m\u00fcd\u00fcrl\u00fck\u00e7e dilek\u00e7e ile itiraz edilebiliyor. Aksi durumda tebligat tarihinden itibaren 60 g\u00fcnden az olmamak \u00fczere i\u00e7erisinde tespit edilen riskli yap\u0131n\u0131n y\u0131kt\u0131r\u0131lmas\u0131 gerekiyor.<\/p>\n<h2><strong>6- G\u00fc\u00e7lendirmede tercih edilebilir mi?<\/strong><\/h2>\n<p>Riskli yap\u0131 olarak tespit edilen yap\u0131n\u0131n y\u0131kt\u0131r\u0131lmas\u0131 yerine yeniden g\u00fc\u00e7lendirilmesi de istenilebiliyor. Riskli yap\u0131n\u0131n y\u0131kt\u0131r\u0131lmas\u0131 i\u00e7in bina sahiplerine verilen s\u00fcrelerde maliklerce, g\u00fc\u00e7lendirmenin teknik olarak m\u00fcmk\u00fcn oldu\u011funun tespit edilmesi, Kat M\u00fclkiyeti Kanunu\u2019nun 19. maddesinin 2. f\u0131kras\u0131nda \u015fu \u015fekilde (4\/5 \u00e7o\u011funluk ile) g\u00fc\u00e7lendirme karar\u0131 al\u0131nmas\u0131 gerekiyor. G\u00fc\u00e7lendirme projesinin haz\u0131rlat\u0131lmas\u0131 ve imar mevzuat\u0131 \u00e7er\u00e7evesinde ruhsat al\u0131nmas\u0131 da aranan \u015fartlar aras\u0131nda yer al\u0131yor. Ayr\u0131ca, g\u00fc\u00e7lendirmenin mahiyetine g\u00f6re ruhsat\u0131 veren idareden belirlenecek s\u00fcre i\u00e7inde g\u00fc\u00e7lendirme i\u015finin yapt\u0131r\u0131lmas\u0131 gerekiyor.
