Ellerinde olan kat irtifak tapular\u0131 ile yap\u0131n\u0131n yap\u0131 kullanma izin belgesi olan iskan ehliyetini alarak tapular\u0131 daha hen\u00fcz kat m\u00fclkiyetine ge\u00e7irmeden banka kredisine uygun konut sat\u0131\u015f\u0131 yapabilmektedir.<\/p>\n<p>Kat \u0130rtifak\u0131 tapusuyla da banka kredisi kullan\u0131labiliyor olma durumu \u00e7o\u011fu zaman t\u00fcketicilere konutla ilgili her resmi prosed\u00fcr\u00fcn tamam ve t\u00fcm i\u015flemlerinde resmi oldu\u011fu alg\u0131s\u0131 versede bazen bu durum d\u0131\u015f\u0131nda belediyelerin yapt\u0131\u011f\u0131 incelemelerle konuta ait projeye uygun olmayan bir yap\u0131la\u015fman\u0131n (ek kat, m2 artt\u0131r\u0131m\u0131 vb.) tespiti edilmesi ile konut ald\u0131ktan 1 ka\u00e7 sene sonra dahi konutun tapu sahibi olarak Belediye\u2018den para cezas\u0131 al\u0131nmas\u0131 gibi ho\u015f olmayan s\u00fcrprizlerle kar\u015f\u0131la\u015f\u0131labiliyor. Bu gibi ho\u015f olmayan durumlar ve konutun tapuda g\u00f6r\u00fcnen sahibi olarak cezai i\u015fleme maruz kalma gibi durumlarla kar\u015f\u0131 kar\u015f\u0131ya gelinmemesi i\u00e7in;<\/p>\n<p>1- Konut al\u0131m\u0131nda tapu tipinin Kat M\u00fclkiyeti \u015feklinde olup olmad\u0131\u011f\u0131 mutlaka kontrol edilmelidir ve de Kat M\u00fclkiyeti tapulu gayrimenkul al\u0131m\u0131na \u00f6nem verilmelidir.<\/p>\n<p>2- E\u011fer Kat \u0130rtifak tapulu gayrimenkul al\u0131nacaksa, proje yap\u0131 kullanma izin belgesi\u2018nin ne zaman \u00e7\u0131kar\u0131laca\u011f\u0131 mutlaka m\u00fcteahhit firmaya sorulmas\u0131 gerekir; bu konuda bir s\u00f6zle\u015fme ya da ipotek kar\u015f\u0131l\u0131\u011f\u0131 bir k\u0131s\u0131m \u00f6deme bekletilmelidir. Kat M\u00fclkiyeti tapusu \u00e7\u0131kart\u0131ld\u0131ktan sonrada kalan bor\u00e7 bakiyesinin \u00f6denmesi gibi alternatif se\u00e7enekler ile g\u00fcvence sa\u011flanmal\u0131d\u0131r.<\/p>\n<p>2- Her ko\u015fulda e\u011fer Kat \u0130rtifak tapusu olan m\u00fclk ediniliyorsa ilgili belediyeler\u2018den in\u015faat ruhsat\u0131 al\u0131nan projeye uygunluk i\u00e7in teyid edilmeli.\u00a0En az\u0131ndan mevcut durum i\u00e7in sorgulama yapmak gerekir.<\/p>\n<p>3- Arsa tapusu olan konut ya da ticari gayrimenkul al\u0131m\u0131nda ise, m\u00fclk legal stat\u00fcde olmaz. Mutlaka ilgili belediye\u2018den resmi durumu ile ilgili bilgi almak gerekir. Sat\u0131lacak milk banka kredisine uygun de\u011fildir. Mutlaka nakit olarak al\u0131n\u0131p sat\u0131lmas\u0131 gerekir. Bu durumda ise sat\u0131\u015f bak\u0131m\u0131ndan da \u00e7o\u011fu zaman ciddi bir olumsuzluktur.
