Site ve apartman ya\u015fam\u0131nda ise her dairenin \u00f6demesi gereken bir &#8216;aidat&#8217; miktar\u0131 vard\u0131r.<\/h3>\n<p>Site ve apartman larda &#8216;aidat&#8217; konusu en \u00e7ok konu\u015fulan konular\u0131n ba\u015f\u0131nda gelmektedir. Baz\u0131lar\u0131 aidat \u00f6demek istemiyor baz\u0131s\u0131da aidatlar\u0131 \u00e7ok buluyor. Ve konu\u015fulan merak edilen bir ba\u015fka konu ise kafalar\u0131 kar\u0131\u015ft\u0131r\u0131yor <strong>&#8216;bo\u015f daireye aidat \u00f6denir mi&#8217;<\/strong><\/p>\n<p>\u00d6rnek olarak 10 daireli bir apartmanda ya\u015f\u0131yorsunuz ve dairelerden birisi bo\u015f. Ev sahibi dairesinde oturmuyor, kiraya da vermiyor.<\/p>\n<p>Bu durumda bo\u015f olan bu daireden aidat al\u0131n\u0131r m\u0131? Sorusu akla geliyor. Evet al\u0131n\u0131r. Yani evin bo\u015f olmas\u0131 ya da dolu olmas\u0131 aidat \u00f6deyip \u00f6dememeyi etkilemiyor. Konut kullan\u0131lsa da kullan\u0131lmasa da ev sahibinin sitenin giderlerine ortak olmas\u0131 gerekiyor.<\/p>\n<p><strong>Kat M\u00fclkiyeti 20. Maddesinde \u015f\u00f6yle belirtiliyor;<\/strong><\/p>\n<p>Madde 20 \u2013Kat maliklerinden her biri aralar\u0131nda ba\u015fka t\u00fcrl\u00fc anla\u015fma olmad\u0131k\u00e7a:<\/p>\n<p>a) Kap\u0131c\u0131, kaloriferci, bah\u00e7\u0131van ve bek\u00e7i giderlerine ve bunlar i\u00e7in toplanacak avansa e\u015fit olarak;<\/p>\n<p>b) Ana gayrimenkul\u00fcn sigorta primlerine ve b\u00fct\u00fcn ortak yerlerin bak\u0131m, koruma, g\u00fc\u00e7lendirme ve onar\u0131m giderleri ile y\u00f6netici ayl\u0131\u011f\u0131 gibi di\u011fer giderlere ve ortak tesislerin i\u015fletme giderlerine ve giderler i\u00e7in toplanacak avansa kendi arsa pay\u0131 oran\u0131nda; (1) Kat\u0131lmakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p>c) Kat malikleri ortak yer veya tesisler \u00fczerindeki kullanma hakk\u0131ndan vazge\u00e7mek veya kendi ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00fcn durumu dolay\u0131s\u0131yla bunlardan faydalanmaya l\u00fczum ve ihtiya\u00e7 bulunmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrmek suretiyle bu gider ve avans pay\u0131n\u0131 \u00f6demekten ka\u00e7\u0131namaz.<\/p>\n<p>Gideri ya da avans pay\u0131n\u0131 \u00f6demeyen kat maliki hakk\u0131nda, di\u011fer kat maliklerinden her biri veya y\u00f6netici taraf\u0131ndan, y\u00f6netim plan\u0131na, bu Kanuna ve genel h\u00fck\u00fcmlere g\u00f6re dava a\u00e7\u0131labilir, icra takibi ba\u015flat\u0131labilir. Gider ve avans pay\u0131n\u0131n tamam\u0131n\u0131 \u00f6demeyen kat maliki \u00f6demede gecikti\u011fi g\u00fcnler i\u00e7in ayl\u0131k y\u00fczde be\u015f hesab\u0131yla gecikme tazminat\u0131 \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr.
