Maddi kayb\u0131n m\u00fcteahhit taraf\u0131ndan giderilmesini isteyen vatanda\u015f, Talas T\u00fcketici Sorunlar\u0131 Hakem Heyeti Ba\u015fkanl\u0131\u011f\u0131na \u015fikayette bulundu.<\/p>\n<p>Heyet, t\u00fcketiciyi hakl\u0131 buldu ve kat m\u00fclkiyeti al\u0131n\u0131ncaya kadar su faturas\u0131 olarak \u00f6denen bin 740 lira tutar\u0131ndaki miktar\u0131n yar\u0131s\u0131n\u0131n m\u00fcteahhitten tahsil edilmesine karar verdi.\u00a0M\u00fcteahhidin karar\u0131 ta\u015f\u0131d\u0131\u011f\u0131 T\u00fcketici Mahkemesi de t\u00fcketiciyi hakl\u0131 bularak, karar\u0131 onad\u0131.<\/p>\n<h3><strong>\u201cT\u00fcketiciler y\u0131llard\u0131r fazla para \u00f6dedi\u201d<\/strong><\/h3>\n<p>T\u00fcketiciler Birli\u011fi Genel Ba\u015fkan\u0131 Mahmut \u015eahin, T\u00fcrkiye\u2019de in\u015faa edilen binalar\u0131n neredeyse yar\u0131s\u0131n\u0131n mesken ruhsat\u0131na sahip olmad\u0131\u011f\u0131n\u0131 belirtti.<\/p>\n<p>Kat m\u00fclkiyeti tapusu olmayan dairelerin su faturalar\u0131n\u0131 <strong>\u201cka\u00e7ak su bedeli\u201d<\/strong> gibi \u00f6dedi\u011fini bunun da normal su fiyat\u0131n\u0131n iki kat\u0131 oldu\u011funu s\u00f6yleyen \u015eahin, <strong>\u201cMilyonlarca t\u00fcketici y\u0131llard\u0131r fazla para \u00f6d\u00fcyor. Burada t\u00fcketicinin bir hatas\u0131 yok. T\u00fcketici ev al\u0131rken mesken masraf\u0131n\u0131 da m\u00fcteahhide \u00f6d\u00fcyor. Hakem heyeti t\u00fcketiciyi hakl\u0131 buldu. \u0130n\u015faat firmas\u0131n\u0131 t\u00fcketici kanununda bulunan ay\u0131pl\u0131 hizmetten dolay\u0131 su\u00e7lu buldu. M\u00fcteahhit de T\u00fcketici Mahkemesine itirazda bulundu. T\u00fcketici Mahkemesi de hakem heyetinin ald\u0131\u011f\u0131 karar\u0131 do\u011fru bularak m\u00fcteahhidin dava talebini reddetti. Bu bir emsal karard\u0131r. T\u00fcketicilerimizi bu konuda duyarl\u0131 olmaya ve haklar\u0131n\u0131 aramaya davet ediyoruz.\u201d<\/strong> \u015feklinde konu\u015ftu.<\/p>\n<h3><strong>\u201cT\u00fcketici hakem heyetine ba\u015fvurmal\u0131\u201d<\/strong><\/h3>\n<p>Mahmut \u015eahin, mesken tapusu al\u0131nmadan \u00f6nceki \u00f6denmi\u015f faturalar\u0131n toplam\u0131 6 bin 860 lira ve alt\u0131nda olan t\u00fcketicilerin hakem heyetine, bundan daha y\u00fcksek olanlar\u0131n ise T\u00fcketici Mahkemesine ba\u015fvurmalar\u0131 gerekti\u011fini dile getirdi. T\u00fcketicilerin ev almadan \u00f6nce bu gibi konular\u0131 ara\u015ft\u0131rmas\u0131 gerekti\u011fini vurgulayan \u015eahin, \u201cBir \u00fcr\u00fcn al\u0131rken nas\u0131l ki yetkili servisi, garantisini dikkate al\u0131yorsak daire al\u0131rken de ayn\u0131 \u015feyleri \u00f6nemsemeliyiz.
